To uphold and defend the constitution; some acts on budgetting unconstitutional?

Just recently the OP reverted some funds cut from the budget of DILG towards acquisition of 911 equipment.  Only HOR can amend the budget;  the OP can not do it.  This also meant that the budget was flawed from the start and now a lot of problems are coming up   The preparation of the budget probably lacked discernment, proper processing and correct leadership

 Some were noted on alleged slip ups:     1.  The blank bicam report  2,  The OP budget was higher than the NEP submitted.

Is there a violation, is someone culpable?   Is this an impeachable offense?   Was the Pres. properly advised by EA a former member of the judiciary?

This post wonders if this is unconstitutional?

It is reported that Gov. Jon Vic Remulla, the brother of DOJ Secretary Boying Remulla will take his oath today as the new DILG Secretary, vice Ben Hur Abalos who is running for senator.

Hmmm.   No Anti Dynasty in Cabinet positions.     There is always a first time.

Cebu loosens rule on face mask; DILG disagrees

Governor Gwen Garcia invoking superiority of local govt over central govt in Local Govt Code, orders loosening of rules on face mask. making it optional outdoors  However DILG disagrees and voids the same order.  The pandemic is still prevalent

The Local Govt Code cant be invoked because the country is still in state of pandemic  Non cooperation is a prohibition which is punishable under the governing law.




ection 9 of the law provides for the acts which are prohibited, namely:

(a) Unauthorized disclosure of private and confidential information pertaining to a patient’s medical condition or treatment;

(b) Tampering of records or intentionally providing misinformation;

(c)      Non-operation of the disease surveillance and response systems;

(d)      Non-cooperation of persons and entities that should report and/or respond to notifiable diseases or health events of public concern; and

(e)      Non-cooperation of the person or entities identified as having the notifiable disease, or affected by the health event of public concern.

Disclosure of confidential information will not be considered violation of this Act if the disclosure was made to comply with a legal order issued by a court of law with competent jurisdiction.

Notable today amid the COVID-19 crisis is the issue on self-quarantine. When an individual does not self-quarantine in case of infection, he or she may be liable under Sec. 9, paragraph d of RA 11332, for non-cooperation of persons and entities that should report and/or respond to notifiable diseases or health events of public concern.

Was PNP law created to have police to be civilian in nature; why are its personnel wearing Battle Dress Attire

The PNP created by RA 6975 and as amended by RA 8551 provided for a police force that is civilian in nature, and under the supervision of DILG. RA 8551

  Section 2. Declaration of Policy and Principles. – It is hereby declared the policy of the State to establish a highly efficient and competent police force which is national in scope and civilian in character administered and controlled by a national police commission

And yet we see police men dressed in Battle Dress Attire (not much different from the Armed Forces military) and them using excessive force in treating civilians.  We overhear them saying "civilians"  With the spate of police being seen killing civilians (of course they are few and isolated) some are led to conclude that police is not civilian in nature.   DILG is one of the Departments having highest budget, the bulk going to salaries of policemen.  

Is it because of the backing by the President to the police force?  That he will send in the lawyers and pardon them in case they get cases for doing their job in the drug war.  

There are some criticism over the  complete control of the military of public health standards, whereas the health workers should be more capable of overseeing the tasks.   All ready there are accusation of weaponisation by the police vs Covid 19

    1.  Arrests were made for violation of curfew
    2.   Military punishments were meted out;
    

Despite the military measures, cases continued to rise and many policemen were infected.   It should be that the police will be called only if health workers orders can not be enforced.   

The police must be civilian in nature, to serve and protect and leave its military garb behind.

Free community food pantries sprout as govt aid is delayed

News just flashed in tv news broadcast that a community pantry is being supervised by barangay staff, that this will be subject to permits according to Usec Dino so that the health of the beneficiaries are supervised, and that proper health protocols are observed.  

What is a community pantry?   It is a spot where residents can take whatever they want and others can donate.  It would seem to be seamless unsupervised social enterprise where residents help one one another.  From one in Quezon City, the phenomenon has inspired about 200 others including one in Boracay, to augment the needs of people who have lost jobs, or simply have nothing to eat. 

Others say, this reflects the lack of initiative and concern by local and national govt to address this need.

So why the regulations?  Why the hullabaloo.?   Who will register if this is just an outpouring of generosity by the community.?

Thats what is hindering our progress -   power play.  The  authorities simply love to throw their weight around and project their power.

There are newsfeeds of:

1.   There were pictures of progressive group advancing their agenda  hence the red tagging.
2.    The sponsors of such free community pantries stopping their operations due to the red tagging.
3.    Sec Roque and DILG are ambivalent towards their treatment of such pantries.
4.    There are citizens abusing the free pantries and who appear to be greedy, destroying the spirit of free community pantries -  it is give and take.  Not take and take only,   or free free for me me me only

Were there enough grounds to fire DILG Sec. Sueno?

I am no Pres Du30, nor do I have total grasp of facts about DILG, the goings on to conclude the correctness of the firing of Sec. Sueno.  From where I am coming from, I can conclude that the allegations about graft and corrupt practices of Sec. Sueno are without basis:   like the buying of the truck by his daughter that coincided with the trip to Austria in connection with the fire truck deal/payment that even began with then Sec of DILG Robredo.

The only basis was the legal of opinion of Usec Hinlo.  It could be just an opinion or conclusion. e That Sueno requested the release of funds from DBM, despite a pending case at SC does not make Sec Sueno corrupt per se.  

It is the usual thing:  intrigues and when the head is not careful, he can side with one of the vicious vipers and destroy his own men
