On Non Payment of Estate Taxes of the Marcoses - Rodriguez vs Ramel

It is more fun criticizing

Critics, candidates for 2022 election may be speaking based on incomplete information and unsubstiated facts about the Marcoses.  One of the main issues is the non payment of the estate taxes.   P23 billion say some, P200 billion says the other.

What is an estate tax?  It is tax to be paid by the heirs when the estate from the deceased is to be transferred  to the heirs.

But in the case of Marcoses  that can not happen yet since the subject properties are subject of litigation
Many opponents even in the debate are speaking with certainty about the said alleged offense

Here is what the Marcos camp have to say



“For the enlightenment of Mr. Ramel, this case is hinged on a legal issue that has yet to attain finality since the government through the public prosecutors has filed a Motion for Reconsideration with the Sandiganbayan, on the forfeiture proceedings on the very same properties that were made the tax base in the computation of the estate tax by the BIR (Bureau of Internal Revenue) thus, the properties subject of the estate tax case are still under litigation,” Rodriguez said in a statement.


“In fact, even BIR and the Presidential Commission on Good Government (PCGG) have arrived at an agreement for the BIR to wait for the decision on the said case before any collection enforcement activities and to establish ownership of the subject properties with certainty to determine with accuracy the fair and just tax base to be used in computing estate taxes, if any,” he added.


How can you or will estate taxes be paid on estate that is subject of litigation and hence can not be transferred to the names of the heirs

As this is still undergoing adjudication, it is suggested that this not be made an issue in the debate or the election.   Instead of having more mileage in the campaign, this clarification may have backfired on those who are trying to gain advantage on a false claim vs the more popular Marcos
