Senate remands impeachment complaint to Congress after forming the impeachment court

Sen Bato de la Rosa (now called Batorney by Sen Alan Cayetano, prompted the formation of the impeachment court.  His motionn was to dismiss the impeachment complaint due to perceived constitutional infirmity.  It was thought to be better of taken up in impeachment court, which the Senate did.

In Sen Cayetanos speech, he deemed it proper to amend Sen de la Rosa motion to read as remanding the impeachment complaint and to fulfill the two conditions:

     1.  To confirm that there are no constitutional infirmities;  (there is - that there were 4 complaints filed in 2025)

     2.   That the 20th Congress will continue pursuing the complaint.

(How can they do that before the June 30th deadline that Sen Tolentino proposed? And that the 20th Congress has not been properly convened)

     To my mind, the motion which was approved by 18 senators (5 against by minority:     Pimentel Hontiveros, Binay, Poe Gatchalian) effectively set obstacles for the conduct of impeachment complaint.

Or worse, effectively dismissed the complaint.

This post is quite queasy and wary of making blog post anymore after the chilling investigation by Tricom HOR inquiry.  Without a declaration of martial law, the administration has effectively muzzled free speech in the country.    There are other pressing issues in the country, like corruption and blunder at the gates of the city.  But muzzling free speech and opposition has been deemed as top priority.

This post has been kept off the computer and android lately because of war on bloggers and freeed of speech  Powerful committees at HOR have been making threats on bloggers and sometimes one thinks that ML has been imposed de facto

One does not earn from this and merely wants to contribute to growth and progress of web.   The actions of the powerful people, who are alleged to be plundering the coffers, leave a bitter taste for many

A third impeachment complaint has been filed by Catholic priests vs. VP Sarah Duterte.  That is a lot of cases to fend off.  May we wish VP Duterte the best of luck to extricate herself from the triple complaints for impeachment.

The big question is why have the two other complaints not moving at all?

Possible answers:

1. HOR is heeding PBBM call?

2.  A political suicide?

3.  Weak allegation/Articles of Impeachment

4.  Not enough time  (Congress is about to go or has gone in Christmas vacation, only 8 days before Congress goes into recess)

Truly the impeachment will divide the nation and people will take sides:    Mindanao and Visayas vs Luzon, pinks, yellow vs leftist.  And we may even see ourselves in Civil war.

SC ruled vs contempt resulting in detention as abuse of authority

SC rules the contempt and arrest order vs Pharmally executive was abuse of authority

The Supreme Court has all ready ruled that Senate in citing for contempt resource persons in Pharmally case is not allowed.   The SC ruled that the investigation  must strictly observe three rules:   1.  That this is in aid of legislation.   2,   The rights of the resource persons must be respected  3.  It must observe its rules.

And yet yesterday, they detained the CS of OVP, a lawyer...

The detention as a result of contempt is rules as abuse of authrotiy.

We observe comments by former president: on     1.  On answerable by yes or no.   2.  On ansswering contents of affidavit that he does not have a copy of as being improper or not allowed.   Or like a question of a partylist young congressman on allegation about deposit  which violated law on bank secrecy.  That they fail to observe proper conduct of inquiry, and being accusatory at time (not reating the resource person with respect to his rights) make the  members of HOR subject o ridicule and/or clueless to what they are doing and may not give high points for them come reelection time

Hence the calls for the quadcomm to disband.  Clearly the topics being dsscussed were executive in nature, and if oversight, then indeed the Constitutional body, COA can investigate.  Or if legalities are involved then NBI and/or DOJ can investigate.   (There is a joke going on regarding  a junk food  and a coffee shop as the origin of Grace Piatto for which they offered a prize of P1M)  The joke is on who?
