Why P12.7 billion in excise taxes from coal mining is unpaid?

A large mining company  has been flagged by a former DOF official not paying the said amount?  Why because from PD 972 to the RA  109631  (Section 151).   The said law  does not contain repealing provision  (The official surmised that a corrupt official had the boiler plate provision usually placed in legislation had this provision removed  Can we amend the to regularize the law)

Section 48. Section 151 of the NIRC, as amended,is hereby further amended to read as follows:

"Sec. 151. Mineral Products -

"(A) Rates of Tax. - There shall be levied, assessed and collected on minerals, mineral products and quarry resources, excise tax as follows:

"(1) On domestic or imported coal and coke, notwithstanding any incentives granted in any law or special law:

"Effective January 1, 2018, Fifty pesos (₱50.00) per metric ton;

"Effective January 1, 2019, One hundred pesos (₱100.00) per metric ton; and

"Effective January 1, 2020, One hundred fifty pesos {₱150.00) per metric ton.

"(2) On all nonmetallic minerals and quarry resources, a tax of four percent (4%) based on the actual market value of the gross output thereof at the time of removal, in the case of those locally extracted or produced; or the value used by the Bureau of Customs in determining tariff and customs duties, net of excise tax and value-added tax in the case of importation.

That is a lot of money   Perhaps if the said company believed in nation building and its leader should think that we actually own nothing and we are simply stewards of Gods creation then that taxes should be paid   Some rabbi say that doing this runs counter to the Lords intention and whatever the companyowns may be taken away.  It is truly right and just.  Some of the leaders of the company are our friends.  

In the GSB we were taught that cheating the people and govt of taxes is not the right way to earn money.   Or underpaying suppliers and workers

No repealing clause   (May amendment kunware Sec 3 of PD 972 but not the taxation part)

Section 86. Repealing Clause. - The following laws or provisions of laws are hereby repealed and the persons and/or transactions affected herein are made subject to the VAT provision of Title IV of the NIRC, as amended:

(a) Section 3 of Presidential Decree (P.D.). 1972, s. 1985, as amended, Sections 4 and 5 of Executive Order No. (E.O.) 1057, s. 1985, and Section 4 of E.O. 1064, s. 1985, insofar as the VAT tax exemption and tax credit is concerned;


Repealing clauses absent

It is very paradoxical that while govt is intent on phasing out jeepneys, and that it has slapped excise tax on diesel price, partially causing its price to double in price. it is giving P5,000 annual pantawid pasada fuel subsidy to jeepney driver

The amount would barely cover 100 liters of fuel,  maybe good for one month pasada.

How does the reported 6% inflation rate really look out there in the market?

What does the report of 6% inflation rate really mean in the market place.  Does it mean that the prime commodities rose by P6 on the average for a P100 good.  May be.

But the reality that bites is that it is not.  The price increases are much higher than that. Say galunggong from P70 to P140 per kg;   gasoline from P20 when fare was  P8 to more than P40 per liter now. Rice used to be P20 per kg to more than P40.  Can the average consumer wage earner keep up.

No wonder talks are ripe for a round of wage increases after we just gave one.   Hmmmp what happened to the theory that by increasing the threshold  of income tax for wage earners, there will be more money to spend.  Yes for the price increases due to excise taxes imposed on gas and others to recover the loss from
tax exemption.  Mali ata....By being political ie favoring the wage  earner by raising tax exemption level, you hurt them harder by excise tax.

Sen Bam was right in asking everyone to reconsider the TRAIN law.  It is a mistake

What does train law meanto ordinary Filipinos?

The authors of the Train Law (the law that increased income tax exemption for workers - a very political move to be popular with voters who are wage earners) promised and stated that they will not affect prices if all minimal. But with gas prices shooting up from P18.00 per  liter to as high as P62.00 for gasoline and P50.00 it is very invevitable that prices will go up.  Equipment renters, truckers are now charging higher for the freight.  Some transport groups have motu propio on their own increased their fares. In the island province that I visited yesterday, the VAN fare shot up by P40.00 and there were not lots of  van going around (maraming LTFRB) patrols and fines for colorum is impounding + P200,000 fine.  Mahirap ding sumakay

I would like to think that taxes and economy is a zero sum game. Nothing is free. Nothing comes from nothing.  Everything must come home to roost, just like a chicken.

It you grant tax exemption, the law taketh away from the people too by way of increase prices of goods (brought about by rising fuel prices and trasnsport/commuting)   In the end the people, the proposed  beneficiary of the TRAIN law, got nothing, got the short end of the promise.

How come.?   Baka dapat amendahan o baguhin ang TRAIN law?   Minadali, kulang pag iiisip, research,debate?

How will the new TRAIN (new improved tax laws) affect the consumers?

None minimal. Say the govt PR people. Talaga ha.... Eh heto na Kuryete tataas na for consumer. Eh sa industrial kaya?  E di apektado cost of goods sold.

Bam Aquino one of those who voted against TRAIN warns of higher prices

This afternoon I put gas in the car I seldom use. The gas is P51 ++ because the station is TRAIN compliant all ready. That is for gas. And when gas prices go up, next to come is the fare increase.  And freight logistic expenses and then prices of prime commodities. Will the govt impose price control eh dagdag gastos ang buwis.

     Here is the reason why:  (look at the amount of excise tax) even for diesel

RAIN mandates the imposition of an excise tax of P2.50 per liter on diesel and bunker fuel in 2018, P4.50 in 2019 and P6 in 2020. Gasoline excise tax meanwhile will increase from P4.35 per liter to P7 per liter this year, P9 in 2019 and P10 in 2020.

While the said TRAIN law is purported to be pro POOR, it not.  The TRAIN law hits every one poor and rich alike because most the taxes are levied on consumption which affect every one.  

All ready, my family members are rooting against me for campaigning for the Pres who ordered this law to be fast tracked...
