The new administration is embroiled in a growing controversy regarding the rise in unprogrammed budget items at the Office of the President.  The rise is to be sourced from GOCC, says the sources.  One of them is Philhealth.  All ready there are questions being raised in courts regarding the legality of such orders 

The charter of Philhealth, being sourced from member contribution says that such moves are not allowed.

Will Supreme Court act on DQ case filed before BBM

Despite comments by various citizen groups that SC still has the power to declare BBM as not qualified to be the President, it most unlikely that it will do so:


1.   BBM has now been proclaimed as President by NBOC;   the DQ case was overtaken by events;
2.   If BBM is not qualified to be candidate it should have been done early on when he ran for:
      1.   Senator,    2.  Vice President.  If he is not qualified now then he should be DQ'd then
3.   It is very unlikely that a person elected by sovereign will of the people can be overturned by decision
      of an appointive body.

Various scenario:
1.   SC justices will not act on petition or act on it at 6th year of BBM office;
2.   SC justices being appointee of Duterte will act on it, and elevate SD the Presidents daughter to Presidency.  (a remote possibility because)
3.   If BBM is disqualified, the next highest number of votes will become the President LR.

We do understand though and there is a precedent that an elective official after having been discovered as an American citizen was DQ'd by a PET and the BBM detractors might be able to do this.

This post anticipate a slew of defamation and cyber crimes to the individuals who called out BBM with hideous names and tags.

A group has reportedly filed disbarment case vs Sen  De Lima for immorality and violation of Lawyers Oath and Lawyers Code of Professional Responsibility .  The group included the VACC Chairman Dante Jimenez, fmr NBI deputy directors Reynaldo Esmeralda, Ruel Lasala, and jueteng whisle blower Sandra Cam

The case was filed vs the lady Senator at the Supreme Court for alleged illicit affair with her body guard Ronnie Dayan.

Earlier, the minority at the House Committee on Justice called for filing of cases vs the same personality after the majority decided not to file cases vs her.

This happens as the Lady is filing cases vs the congressmen and the witnesses who figured on coming out with testimonies against the lady

In other countries, say Japan, the same persona could have resigned if not committed harakiri

In a pre departure speech, the expletive of PI was mentioned by Pres. Duterte vs Pres Obama
to quote:

"You must be respectful. Do not just throw away questions and statements. Putang ina, mumurahin kita diyan sa forum na iyan. This led to the cancellation of the bilateral talks between Pres Obama and Duterte.  Presidential Candidate Hillary Clinton remarked that Pres Obama was right, she said in cancelling the talk, after being called "son of a whore"

n  a 47 year old ruling SC under then Justice Querubin Makalintal ruled that the expression is that of an anger and should not be defamatory nor refer to the virtues of the mother.

This was further seconded by Public Attorney's Chief Persida Acosta that one could not be held liable for uttering this word. She recalled that her grandparents would utter PI even after attending a mass

Group petitions SC on political dynasties

Social and political criticisms

A group filed a 24 page petition with Supreme Court regarding political dynasties precisely that this practice is unconstitutional (culpable violation of Sec. 26 of Art II) of the constitution.

This post wish the petitioners good luck.  The SC has no course of action since there has been no enabling law to enforce the said constitutional provision.  How would the legislators legislate against their status quo?

All they can do is issue a TRO...

Or we can impeach;   no RA to talk about.

Or let our votes just speak.

It is better that way.  It is important we know who are violating the constitution and simply vote them out. Este boot them out.

Judges and the Rest of Judiciary Throws in Support Behind SC CJ Renato Corona

Despite the declaration of Malacanang that it is not fighting the judicial branch of government, two sepaerate l/2 paid advertisements from judges and the judiciary came out in leading daily manifesting support for the Chief Justice.  It is expected that in this country, majority rules;  plebiscite or petitions can sway judgements and facts.  (Like an opinion when repeated so often becomes a fact?)

Whatever is the outcome of this crisis, this blog wishes that:    l.  dispensation of justice shall be faster, 2.  that Eraps accusation vs criminals in robes is not true;   3.  that there will be more maturity in handling difficulties by the executive branch with the judiciary.

They often say, you cant fight City Hall.  Well, the executive branch thinks it can slug it out with the judiciary.  A mature president, using Sun Tzu strategem, would have used the alliance of the judiciary in some other subtle way to get what he wants.  Well, this needs political savvy and maturity. We are not war, and obviously, force is sometimes applied in handling this conflict.

They say that if you are an opposition in Congress, sooner or later, you will have to side with the majority/administration because the executive, DBM has the control over the budget and disbursement of the CDF. But the current tactics are less than subtle and subdued.
