Names of "innocent" businessmen like Hillmarc and that of ANI Pres. Antonio Tiu were claimed to have been dragged into the alleged VP Binay plunder case.
Hillmarc was alleged by former vice mayor Mercado which constructed part of the Binay 350 hectare estate in Rosario Batangas. The Estate supposedly contains:
1. A resort;
2. Car garage for 40 cars;
3. Horse race track
4. Airconditioned pig farm
5. A UK type garden (even bigger than UK)
VM Mercado said he knows this to be true since he was the VP errand boy for this project since l992. The people of Rosario Batangas know very well that the estate belongs to VP Binay.
The Binay camp behementlydenies the allegation. ie that Binay does not own the estate. However some paper trail says that Sun Champ was bought by a company which shows link to the Binay law office.
What about the Estate in Rosario Batangas?
1. Sometime in August Sen Trillanes graced the launching of the Sun Champ Agri Tech tourism in the said area;
2. The said agri tech is headed by Antonio Tiu, head of ANI, Agri Nutrition Inc, an agri products distribution; the said company is owned by another company, the corporate secretary of which is a partner of the Binay law office
3. ANI used to be Mabuhay Holdings, which in the COA audit supplied over priced hospital equipment to Ospital ng Makati. AT vehemently denies link with the the Binay
The plot gets thicker.
The jurisdictional issue/challenge thrown vs. the subcommitte was junked by the chairman Pimentel, the power to investigate and legislate having been upheld by SC
Sen Cayetano's statement:
He appealed to VP Binay to appear
1. The accused party is presumed to be innocent until such time that the evidence is presented. But when the evidence is presented, the presumption of guilt shifts. It is now the duty of the accused to refute.
2. Under the law, when the income cannot support the assets, there is conclusion of graft.
1. If VP Binay got 44 million income from piggery, how much was the piggery investment? Is it in the SALN
2. If indeed a legitimate corporation acquired the 350 hectare estate, then the proceeds of that between 500 million to 2 billion, they should appear in the SALN
On the Makati 2 building:
1. Cuervo estimates the value to be only P700 million thereabouts (not P2 billion as priced now)
2. It is not a premium building
3. Some architectural company says that the P70t to P80t unit cost is not so.
