Ignorance of the law excuses no one especially if you occupy senior position

"With great power, comes great responsibility "  spiderman.

It is highly expected that the top govt officials will have strong sense of right and wrong.  (Even Chinese philosopher suggests this businessman -  right and wrong must be clearly established)

However, observations in the pronouncement and hearing did not or does seem to indicate that the current chief being investigated is aware that what he did is legally wrong and Rappler  thinks the good general may have violated 4 laws:





These laws, which regulate the act or practice of gift-giving to public officials, are:
  1. Articles 210-212 of the Revised Penal Code
  2. Republic Act No. 3019 (Anti-Graft and Corrupt Practices Act)
  3. Republic Act No. 6713 (Code of Conduct and Ethical Standards for Public Officials and Employees)
  4. Presidential Decree 46 (Making it Punishable for Public Officials and Employees to Receive, and for Private Persons to Give, Gifts on Any Occasion, including Christmas)
I noted that when we were dealing with BSP, we brought gifts as a matter of tradition to some middle managers.  And they were promptly, though very embarrassing for us, because I did not know it violated PD 46

However, as we are negotiating with an LGU for a alteration of plans, we were told to come across so that the good councilor can fund their social amelioration projects.  My my my my.  That is under #3....

And yet the Palace continues to back up the PNP chief who is being investigated.  May be the wise thing to do is to back off and that silence this time may be golden.
